　　【論文摘要】 我國刑事訴訟中超期羈押現(xiàn)象長期以來一直未能得到有效遏制,已經(jīng)出臺(tái)了的有關(guān)糾防超期羈押的制度也未得到真正落實(shí).為此,本文在闡述了超期羈押的概念,危害性及其長期存在的原因的基礎(chǔ)上,著重提出了一些解決超期羈押的對策:轉(zhuǎn)變執(zhí)法觀念,提高執(zhí)法人員素質(zhì);填補(bǔ)現(xiàn)行法律漏洞,完善羈押立法規(guī)定;完善對超期羈押的監(jiān)督機(jī)制和救濟(jì)程序;建立羈押的替代措施
