論民事執(zhí)行權(quán)的性質(zhì)
摘 要
民事執(zhí)行權(quán)的性質(zhì)，主要是指該權(quán)力的國家分權(quán)屬性，即在國家的基本權(quán)力類型中，民事執(zhí)行權(quán)所屬的類別，其在實踐中表現(xiàn)為司法性和行政性的雙重特征。分析民事執(zhí)行權(quán)的性質(zhì)，對于完善民事執(zhí)行理論，合理設(shè)置民事執(zhí)行機關(guān)、科學規(guī)范民事執(zhí)行程序、保障司法公正具有重要的指導意義。

ABSTRACT

Its express to judicial with the administration and dual characteristic in the fulfillment. The analysis civil enforcement powers kind is important, for the leading meaning that the perfect civil case carry out the theories, reasonable to establish the civil case to carry out the organization, science the norm civil case to carry out the procedure, guarantee the judicatory fair.
